kissph Terms & Conditions – User Agreement for the Platform

1. Acceptance of Terms

By registering for a kissph account, logging in to the platform, depositing funds, placing bets, or engaging in any gaming activity, you expressly agree to comply with and be bound by these Terms and Conditions, our Privacy Policy, and our Responsible Gaming Policy.

Your continued use of kissph following any amendments to these Terms constitutes acceptance of those changes. It is your responsibility to review these Terms periodically. kissph reserves the right to modify these Terms at any time, with or without prior notice, and such modifications shall become effective immediately upon posting to the kissph website.

2. Eligibility and Age Restriction

2.1 Age Verification

kissph reserves the right to request proof of age and identity at any time, including but not limited to the point of registration, first deposit, or first withdrawal. Acceptable forms of identification include a valid Philippine passport, driver's license, UMID, or any government-issued ID displaying your full name, date of birth, and photograph.

2.2 Geographic Restrictions

The kissph platform is intended exclusively for users physically located within the Republic of the Philippines at the time of access. Users accessing the platform from jurisdictions where online gambling is prohibited or restricted are solely responsible for compliance with local laws. kissph does not accept players from jurisdictions where the operation of online gambling services is unlawful.

2.3 Legal Capacity

By creating a kissph account, you represent and warrant that you have the legal capacity to enter into a binding contract under Philippine law, that you are not prohibited from gambling under any applicable law, and that you are not currently self-excluded from gambling activities through any national or regional self-exclusion program.

3. Account Registration and Security

3.1 Account Creation

To use the kissph platform, you must register for an account by providing accurate, current, and complete information, including your full legal name, date of birth, mobile phone number registered in the Philippines, and email address. You are permitted to hold only one (1) account with kissph. The creation of multiple accounts (commonly known as "multi-accounting") is strictly prohibited and constitutes a material breach of these Terms.

3.2 Account Credentials

You are solely responsible for maintaining the confidentiality of your kissph account username and password. You agree not to disclose your login credentials to any third party. Any activity that occurs under your account is your responsibility, regardless of whether such activity was authorized by you. You agree to notify kissph immediately if you suspect any unauthorized access to or use of your account.

3.3 Accuracy of Information

You agree to provide true, accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate and current. kissph reserves the right to suspend or terminate your account if any information provided is found to be false, misleading, or incomplete.

3.4 Know Your Customer (KYC) Requirements

kissph is committed to preventing fraud, money laundering, and underage gambling. As part of our compliance obligations, we reserve the right to request additional documentation to verify your identity and address at any time. Failure to provide requested documentation within a reasonable timeframe may result in account suspension and the withholding of withdrawals until verification is complete.

4. Deposits and Payment Methods

4.1 Accepted Payment Methods

kissph accepts deposits via GCash, PayMaya, bank transfers from major Philippine banks (including BPI, BDO, Metrobank, and others), and other payment methods as may be specified on the platform from time to time. All deposits must be made in Philippine Peso (PHP).

4.2 Deposit Processing

Deposits made via e-wallet services such as GCash and PayMaya are typically credited to your kissph account instantly. Bank transfers may take longer to process depending on your financial institution. kissph is not responsible for delays caused by third-party payment processors or banking institutions.

4.3 Source of Funds

You warrant that all funds deposited into your kissph account are derived from legitimate sources and are your own property. kissph reserves the right to investigate the source of deposited funds and to refuse deposits or freeze accounts where we have reasonable grounds to suspect money laundering, fraud, or other criminal activity.

4.4 Minimum and Maximum Deposit Limits

kissph may impose minimum and maximum deposit limits, which are displayed on the platform at the time of deposit. These limits may vary depending on your chosen payment method and account status.

5. Withdrawals and Payout Procedures

5.1 Withdrawal Requests

You may request a withdrawal of funds from your kissph account balance at any time, subject to the completion of any applicable wagering requirements, bonus conditions, and verification procedures. Withdrawals are processed using the same payment method used for deposit, where possible.

5.2 Verification Before Withdrawal

kissph reserves the right to require account verification (including submission of government-issued identification, proof of address, and proof of payment method ownership) before processing any withdrawal. First-time withdrawals, large withdrawal amounts, or withdrawals to new payment methods may be subject to additional verification and processing time.

5.3 Processing Times

Withdrawal requests are typically processed within 24 to 48 hours after approval. GCash and PayMaya withdrawals are generally completed within 30 minutes after approval. Bank transfer withdrawals may take 1 to 3 business days depending on your financial institution. kissph is not responsible for delays caused by third-party payment processors.

5.4 Withdrawal Limits and Fees

kissph may impose minimum and maximum withdrawal limits, which are displayed on the platform. kissph does not charge withdrawal fees under normal circumstances; however, your payment provider or bank may impose its own transaction fees, for which kissph is not responsible.

5.5 Anti-Money Laundering (AML) Policy

In compliance with Philippine anti-money laundering regulations, kissph requires that all deposited funds be wagered at least once before a withdrawal can be processed. This requirement may be waived in exceptional circumstances at the sole discretion of kissph management.

6. Bonuses, Promotions, and Wagering Requirements

6.1 Bonus Terms

kissph may offer various bonuses, promotions, free spins, cashback offers, and other incentives to players from time to time. All bonuses are subject to specific terms and conditions, including wagering requirements, game restrictions, maximum bet limits, and expiration dates. These terms are provided at the time the bonus is offered and are incorporated into these Terms by reference.

6.2 Wagering Requirements

Unless otherwise specified, all bonuses are subject to wagering requirements before any winnings derived from the bonus can be withdrawn. 6.3 Bonus Abuse

kissph reserves the right to void bonuses, cancel winnings, and close accounts where we have reasonable grounds to believe that a player is abusing or attempting to abuse bonus offers. Prohibited bonus abuse activities include but are not limited to: creating multiple accounts to claim the same bonus multiple times, wagering patterns designed solely to meet wagering requirements with minimal risk, and collusion with other players to manipulate bonus outcomes.

6.4 Withdrawal of Bonus Funds

Bonus funds cannot be withdrawn directly. Only winnings generated from bonus funds that meet the applicable wagering requirements are eligible for withdrawal. Upon meeting wagering requirements, bonus funds are converted to real-money balance and become available for withdrawal.

7. Gameplay Rules and Fair Play

7.1 Game Integrity

All games offered on the kissph platform are provided by licensed third-party game providers and use certified Random Number Generator (RNG) technology to ensure fair and unbiased outcomes. kissph does not control or influence the outcome of any game.

7.2 Game Rules

Each game available on the kissph platform has its own specific rules, payout tables, and return-to-player (RTP) percentages. It is your responsibility to familiarize yourself with the rules of each game before placing any wagers. Game rules are accessible within each game interface.

7.3 Malfunctions and Disconnections

In the event of a game malfunction, software error, or server disconnection, all affected bets and game rounds shall be void, and affected wagers shall be refunded to the player's account. kissph is not liable for losses incurred due to technical malfunctions beyond our reasonable control. In cases of dispute regarding game outcomes, the official game server records maintained by the game provider shall be considered final and binding.

7.4 Sports Betting Rules

For sports betting activities, all bets are settled based on the official result of the event as determined by the relevant sports governing body. kissph reserves the right to void bets placed after the start of an event, to cancel bets on events that are postponed or abandoned, and to apply specific rules for each sport as detailed in our Sports Betting Rules section.

8. Responsible Gaming and Player Protection

8.1 Age Restriction

As stated in Section 2, all players must be at least 21 years of age. kissph operates a strict age verification policy and employs reasonable measures to prevent underage access to the platform.

8.2 Self-Exclusion and Time-Outs

kissph offers self-exclusion and time-out tools that allow you to temporarily or permanently restrict your access to the platform. Self-exclusion periods can be set for durations ranging from 24 hours to permanent exclusion. During a self-exclusion period, you will be unable to access your account, place bets, or make deposits. 9. Prohibited Activities and User Conduct

The following activities are strictly prohibited on the kissph platform. Engaging in any of these activities constitutes a material breach of these Terms and may result in immediate account termination, forfeiture of funds, and legal action:

• Fraudulent Activity: Using stolen credit cards, e-wallets, or bank accounts; providing false identification; or engaging in any form of payment fraud.
• Multi-Accounting: Creating or operating more than one kissph account, or allowing another person to access your account.
• Collusion: Collaborating with other players to gain an unfair advantage, sharing information about game outcomes, or coordinating betting patterns.
• Bonus Abuse: Exploiting bonuses or promotions in a manner inconsistent with their intended purpose, as described in Section 6.3.
• Use of Automated Systems: Using bots, scripts, crawlers, or any automated system to access the platform, place bets, or manipulate game outcomes.
• Advantage Play and Exploitation: Exploiting software bugs, game vulnerabilities, or system errors to gain an unfair advantage.
• Money Laundering: Using the kissph platform to launder money or conduct any illegal financial transactions.
• Abusive Behavior: Engaging in abusive, threatening, or harassing behavior toward kissph staff, customer support agents, or other players.
• Underage Gambling: Allowing a person under the age of 21 to access or use your kissph account.

kissph reserves the right to investigate any suspected violation of these Terms, to cooperate with law enforcement authorities, and to take any action deemed necessary to protect the integrity of the platform and the interests of legitimate players.

10. Limitation of Liability and Disclaimers

10.1 Service Availability

kissph strives to maintain continuous availability of the platform; however, we do not guarantee uninterrupted access. The platform may be temporarily unavailable due to scheduled maintenance, technical issues, or circumstances beyond our control. kissph is not liable for any losses resulting from service interruptions.

10.2 Third-Party Services

kissph uses third-party game providers, payment processors, and other service providers. While we select reputable partners, we are not responsible for the performance, availability, or actions of these third parties. Any disputes with third-party providers must be resolved directly with the provider.

10.3 Disclaimer of Warranties

The kissph platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. kissph does not warrant that the platform will be error-free, secure, or free from viruses or other harmful components.

10.4 Limitation of Damages

To the fullest extent permitted by applicable law, kissph, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the platform, even if kissph has been advised of the possibility of such damages.

10.5 Maximum Liability

In no event shall kissph's total aggregate liability to you for all claims arising out of or related to your use of the platform exceed the amount of funds you have deposited into your kissph account during the six (6) months preceding the event giving rise to the claim.

11. Account Suspension and Termination

11.1 Suspension by kissph

kissph reserves the right to suspend or terminate your account at any time, with or without notice, if we have reasonable grounds to believe that you have breached these Terms, engaged in fraudulent or illegal activity, or if required to do so by applicable law or regulatory authority. Upon termination, any remaining real-money balance (excluding void bets, bonus funds, or disputed amounts) will be returned to you via your registered payment method, subject to verification.

11.2 Voluntary Account Closure

You may close your kissph account at any time by contacting customer support. Upon account closure, any remaining real-money balance will be returned to you after completion of any pending wagering requirements and verification procedures. Bonus funds and unredeemed promotional credits will be forfeited upon account closure.

11.3 Dormant Accounts

Accounts that remain inactive (no login or gameplay activity) for a continuous period of twelve (12) months or more may be classified as dormant. kissph reserves the right to charge an administrative fee on dormant accounts or to close dormant accounts and escheat remaining balances in accordance with applicable law.

12. Amendments and Modifications to Terms

kissph reserves the right to amend, modify, or update these Terms and Conditions at any time, at our sole discretion. Material changes to these Terms will be communicated to users via email, platform notification, or prominent notice on the kissph website. Your continued use of the platform following any such changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically to stay informed of any updates. If you do not agree with any changes to these Terms, you must immediately cease using the kissph platform and close your account.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and Conditions, and any disputes arising out of or related to your use of the kissph platform, shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.

13.2 Dispute Resolution

In the event of any dispute between you and kissph, you agree to first attempt to resolve the dispute informally by contacting our customer support team. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate formal dispute resolution proceedings.

13.3 Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or your use of the kissph platform shall be brought exclusively in the courts of the Republic of the Philippines, and you consent to the personal jurisdiction of such courts.
